Wayfindr — End User Licence Agreement

This End User Licence Agreement ("EULA") is a legal agreement between you ("User" or "you") and HH Ventures ("we", "us" or "our"), the owner and operator of the Wayfindr platform, application, and associated services (collectively, the "App"). By downloading, installing, or using the App, you agree to be bound by the terms of this EULA. If you do not agree, do not download or use the App.

This EULA should be read alongside our Terms & Conditions and Privacy Policy. In the event of any conflict between these documents, this EULA takes precedence in relation to your use of the App.

1. Grant of Licence

Subject to your compliance with this EULA, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to download and use the App on devices that you own or control, solely for your personal, non-commercial purposes.

This licence does not include the right to sublicence, sell, assign, or otherwise commercially exploit the App or any content or functionality generated through it.

2. Scope of Permitted Use

2.1 Permitted Uses

You may use the App solely for the following purposes:

Planning walking, hiking, and trail-running routes in the United Kingdom through natural language input.
Viewing AI-generated route suggestions, including elevation profiles, estimated distance, and journey time.
Requesting an indicative weather forecast matched to a planned departure time and points along a generated route.
Exporting generated routes as GPX files for personal use with compatible third-party devices and applications.
Using in-app navigation mode to track your position against a generated route on an OS-style map.
Accessing cached offline maps for use in areas without mobile data connectivity.
Refining routes through conversational interaction within the App.

2.2 Restrictions

You must not:

Copy, modify, adapt, translate, or create derivative works based on the App or its underlying software.
Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.
Remove or obscure any proprietary notices, branding, or labels within the App.
Develop a competing product or service using the App's functionality, outputs, or underlying technology.
Share, distribute, publish, or commercially exploit routes, navigation outputs, or other content generated by the App without our prior written consent.
Use automated tools, bots, scrapers, or scripts to access, extract, or harvest data from the App.
Use the App in any manner that is unlawful or in violation of applicable laws or regulations, including the Highways Act 1980 and the Countryside and Rights of Way Act 2000.
Circumvent, disable, or interfere with security features of the App, including offline caching protections or GPS-based functionality.

3. Ownership and Intellectual Property

All software, data, map integrations, interface elements, route-generation algorithms, AI systems, and associated documentation in or related to the App are and remain the intellectual property of HH Ventures and its licensors. Nothing in this EULA transfers any ownership of intellectual property to you.

The App incorporates Ordnance Survey map data under licence, and integrates with Google Places and other third-party data providers. Your use of the App is subject to the terms of those licences.

4. App Functionality and Accuracy

4.1 Route Generation

Routes are generated by an AI system using Ordnance Survey path data, rights-of-way information, and Google Places. Route data may contain errors, omissions, or information that has become outdated. You are solely responsible for verifying that any route is safe, legal, and appropriate for your group and conditions before commencing your outing.

4.2 Navigation and Off-Route Alerts

Navigation mode uses your device's GPS sensor. GPS accuracy depends on your device and environmental conditions and may not be reliable in remote areas, valleys, or under dense tree cover. Off-route alerts are provided as guidance only and must not be relied upon as a primary safety mechanism.

4.3 Offline Map Caching

Cached maps reflect data at the time of download and may not reflect subsequent changes to paths, rights of way, or land access. We make no guarantee that cached map data will remain current during your outing.

4.4 GPX Export

GPX files are provided for personal use only. We accept no responsibility for how exported GPX files are used on third-party devices or applications.

5. Safety and User Responsibility

Wayfindr is an AI-assisted route planning tool. It is not a substitute for appropriate outdoor preparation, navigation skills, physical fitness, or the judgement of an experienced outdoors person. By using the App you acknowledge that:

You are solely responsible for assessing the safety and suitability of any route for your group, fitness level, experience, and prevailing conditions.
You should carry appropriate paper maps, navigation tools, and safety equipment, particularly in remote or mountainous terrain.
Weather, ground conditions, daylight hours, and other environmental factors remain your responsibility to assess. Any forecast shown by the App is indicative, may change, and is not a real-time hazard warning or an assessment that a route is safe. Check official forecasts and warnings again before setting off.
Activity-specific routing attempts to use legally appropriate rights of way for each activity, but legal access rights may change. You are responsible for ensuring your route complies with the Countryside and Rights of Way Act 2000, the Land Reform (Scotland) Act 2003, and any local byelaws.
HH Ventures accepts no liability for injury, loss, or damage arising from your use of the App or reliance on routes, navigation, or information provided through it.

6. Data and Privacy

Your use of the App is subject to our Privacy Policy, incorporated into this EULA by reference. The App collects and processes GPS and location data solely for route generation, navigation, and off-route alerting. This data is processed on-device where technically possible.

Conversational inputs you provide to generate or refine routes may be used in anonymised and aggregated form to improve the AI systems that power the App. We will not use your personal inputs to train models in a manner that identifies you without your explicit consent.

7. Updates and Changes to the App

We may update the App from time to time, including changes to features, supported activities, or third-party integrations. We may also withdraw features at our discretion. Where we make material changes, we will endeavour to notify you via the App or email.

We may also update this EULA from time to time. Continued use of the App following notification of an updated EULA constitutes your acceptance of the revised terms.

8. Suspension and Termination

We may suspend or terminate your access to the App at any time and without notice if you breach this EULA, if we are required to do so by law, or if we discontinue the App. You may stop using the App at any time.

On termination, all licences granted under this EULA cease immediately. Clauses that by their nature survive termination (including Sections 3, 5, 9, 10, 11, and 12) shall continue in full force.

9. Disclaimer of Warranties

The App is provided "as is" and "as available." To the fullest extent permitted by applicable law, HH Ventures makes no representations or warranties, including that: the App will be uninterrupted or error-free; AI-generated routes will be accurate, complete, legally valid, or safe; GPS navigation will function correctly on all devices or in all areas; offline cached maps will be current at the time of use; or the App will be compatible with all devices or third-party applications.

Nothing in this EULA excludes any warranty or liability that cannot be excluded under the Consumer Rights Act 2015.

10. Limitation of Liability

To the fullest extent permitted by applicable law, HH Ventures shall not be liable for: personal injury, accident, or death arising from reliance on a route or navigation output; loss of data or GPS failure during an outdoor activity; trespass, access disputes, or legal consequences arising from use of a generated route; or loss arising from reliance on outdated cached maps.

Where liability cannot be excluded, our total liability shall not exceed the amount you paid to us in the twelve months preceding the claim, or £50, whichever is greater.

11. Third-Party Services and Links

The App integrates with Ordnance Survey, Google Places, Met Office weather data, and device GPS sensors. We are not responsible for their accuracy, availability, or terms of use. The App may contain links to third-party websites; we do not endorse and are not responsible for their content.

12. Governing Law and Disputes

This EULA is governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, except that users in Scotland or Northern Ireland may bring proceedings in their local courts.

13. General

13.1 Entire Agreement. This EULA, together with our Terms & Conditions and Privacy Policy, constitutes the entire agreement between you and HH Ventures with respect to your use of the App.

13.2 Severability. If any provision is found invalid or unenforceable, it shall be modified to the minimum extent necessary. Remaining provisions continue in full force.

13.3 Waiver. Failure to enforce any provision shall not constitute a waiver of that or any other provision.

13.4 Assignment. You may not assign rights under this EULA without our prior written consent. We may assign this EULA to any successor entity.
